Divorce documentation in Pakistan refers to the official paperwork required to formally record and process a divorce. Divorce Procedure, Eligibility, and Cost

In Pakistan, there are two primary ways to end a marriage: divorce and dissolution of marriage through Khula. While men have the right to divorce their wives, women can seek divorce through Khula, where they request the court to dissolve the marriage. Additionally, couples can mutually agree to divorce.

Step-by-Step Procedure for Filing Divorce

A man can initiate divorce by verbally pronouncing it. However, if the husband wants to formally proceed with the divorce, he must issue a divorce notice through the court. Alternatively, if both parties agree, the divorce process can be initiated mutually.

  1. Obtain Divorce Papers/Deed

    The divorce deed, which officially announces the divorce, includes details of dower, maintenance, and other financial agreements. The deed will be sent to the court, and copies will be provided to both parties. The court will summon both husband and wife to attend hearings, appoint arbitrators, and attempt reconciliation.

  2. Reconciliation Opportunity

    Before finalizing the divorce, the court offers a reconciliation period. Both parties are required to attend family court sessions and may each appoint two family members to assist with reconciliation. If successful, the divorce process will be canceled. If reconciliation fails, the divorce proceedings continue.

  3. Obtain Nadra Divorce Certificate

    After the reconciliation period ends, if no resolution is reached, the court will finalize the divorce. You can then apply for your official divorce certificate from NADRA.

Documents Required for a Divorce Certificate

To obtain a divorce certificate, the following documents are necessary:

  • CNIC copies of both husband and wife
  • CNIC copies of the father of both parties
  • Original divorce papers (Talaq Nama)
  • Court-issued undertaking
  • Copy of the court’s final order
  • Witnesses from both sides
  • Photocopy of the original Nikah Nama
