How to File a Khula Case in Pakistan

Khula is a woman’s right to seek divorce if her husband is unwilling to grant it. Here’s a brief guide on how to file for Khula:

  1. File a Khula Suit

    The woman must consult a family lawyer and file a Khula suit in court. Valid reasons for seeking Khula, such as marital issues, need to be provided.

  2. Khula Notice

    The court will send a notice to the husband, asking him to attend the hearing and respond. If the husband agrees, reconciliation may be attempted.

  3. Reconciliation Attempt

    The court will offer a chance for both parties to reconcile. If the woman does not wish to reconcile, the case proceeds to the next stage.

  4. Final Hearing

    The wife and lawyer present evidence supporting the Khula request. If successful, the court issues a Khula order.

Khula can be filed for reasons like:

  • Husband abandonment for over 4 years.
  • Failure to provide living expenses for 2+ years.
  • Polygamy without consent.
  • Abuse or forced marriage.
